Terms of service

These terms cover your use of Cirqon — the website, the two mobile apps, and the portals used by collectors and recovery facilities. Using any of them means accepting them.

Who provides this service

Cirqon Africa Limited, a company registered in Kenya. Where these terms say “we” or “Cirqon”, that is who is meant.

What Cirqon is, and is not

Cirqon is a platform, not a waste collector. We connect you with a licensed collector and give both of you the tools to run the arrangement — schedules, records, invoices, messages. The collection itself is a contract between you and that collector.

That means the quality, timeliness and safety of a collection are the collector's responsibility. We will help you raise a complaint and we escalate ones that go unanswered, but we are not the party performing the service.

Payments

Cirqon does not take your money. When you owe your collector, you pay that collector directly — by the paybill, till or bank details they have published, or in cash. We show you what you owe and what you have paid; the payment itself does not pass through us.

A receipt shown in Cirqon reflects a payment your collector has recorded. If you have paid and it is not showing, raise it with your collector — they are the ones who received it.

Prices are set by your collector, not by us. Where a collector charges a platform fee or commission to Cirqon, that is a matter between us and them and does not change what you owe.

Your account

Keep your password to yourself. Anything done through your account is treated as done by you, so tell us immediately if you think someone else has access.

Give us accurate details. An address that is wrong means a crew that cannot find you, and a phone number that is wrong means you will not be told when they are coming.

If your organisation gave you the account — as a collector's or facility's staff member — your organisation controls what you can see and can remove your access.

Reporting environmental issues

Anyone can report illegal dumping, burning or a similar problem, with or without an account. Reports go to Cirqon and to the public body responsible for that location.

Report honestly. A false or malicious report wastes the time of an authority that has real problems to attend to, and we will refuse reports from anyone who abuses this.

We cannot promise an authority will act, or act quickly. What we can promise is that the report reaches them and that you can track its status.

Acceptable use

  • Do not use Cirqon to break the law or to help anyone else do so.
  • Do not try to reach data belonging to another household, collector or facility, or probe the platform for ways to do it.
  • Do not upload anything you have no right to upload, or photographs of people who have not agreed to be photographed.
  • Do not attempt to disrupt the service for others.

What you upload

Photographs, logos and text you upload remain yours. You give us permission to store and display them for the purpose you uploaded them for — a proof-of-collection photo shown to the household it belongs to, a collector's logo shown to their clients.

We may remove content that breaks these terms or the law.

Availability

We work to keep Cirqon running but we do not guarantee it will always be available. Maintenance, faults and problems at our suppliers can interrupt it.

The apps hold your day's work on the device so a crew can keep collecting without a signal, and sync when the connection returns. That is a convenience, not a guarantee.

Our responsibility to you

Nothing in these terms limits liability where the law does not allow it to be limited, including for death or personal injury caused by negligence, or for fraud.

Beyond that, we are not responsible for the acts of a collector or a recovery facility, for business losses, or for loss caused by information you gave us being inaccurate.

Ending the arrangement

You can stop using Cirqon at any time and ask us to close your account. Ending your Cirqon account does not by itself end your agreement with your collector — settle that with them.

We may suspend or close an account that breaks these terms, and will say why unless we are prevented from doing so.

Governing law

These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute arising from them.
